ALL ABOUT GOVERNOR POWER IN INDIAN CONSITUTION
GOVERNOR OF INDIA
1) Firstly eligibility criteria of selection of governor is given in Article 157 and 158 of Indian constitution , which are given as,
A Governor of india must .
a) Citizen of India.
b) At least 35 years age.
c) Not be a member of either house of the parliament or house of the state legislature.
d) Not hold any other office of profit.
2) Article 159 of Indian constitution consist oath of state governor.
3) The governor all executive and legislative power listed in article 167C ,200 ,213 & 355 of Indian constitution .
a) Executive Powers: This power related to the administration appointment and removals.
The governor appoint CM of state. The council of minister remain in power during the "Pleasure " of the governor of state but real sense it means the pleasure of the legislative assembly.
The governor also appoints Advocate General of State and also chairman and members of state public service commission .
The President consults the governor of state for the appointment of Judge of high court . But the appointment of district court judges by governor .
b) Legislative Powers: The governor summons the session of both houses of state legislature and Prorogue( Defer , postpone) them. The governor can even dissolve the vidhan sabha.
The governor inaugurates the state legislature by addressing it after the assmebly elections and also at the beginning of the first session in every year.
The governor can return a bill to a state legislature if it is not a money bill . However if the state legislature sends it back to the governor for second time , the governor must assent to it.
As per Article 165 and 177 , Governor can ask the Advocate general to attend the proceedings of both houses and report to him.
Under Article 192 , Governor is empower to disqualify a member of a house of state legislature when election commission recommends.
4) There is no provision for impeachment of The Governor , as it happens for the President .
5) Governor Rule is applicable only to J&K state.
6) West Bengal Governor M.K.Narayana is the first every governor to be questioned by police in a criminal case.
